Terms and Conditions
The agreement between you and WPPres covering your StorePOS licence.
These terms govern your purchase and use of StorePOS. Please read them before you buy. By purchasing a licence or installing the plugin you agree to be bound by them.
1. Who we are
StorePOS is published and operated by WPPres (“WPPres”, “we”, “us” or “our”). References to “the Software” mean the StorePOS plugin, any extensions we supply with it, and its documentation. References to “you” mean the individual or organisation purchasing or using a licence.
You can reach us at any time through our contact page.
2. The licence we grant you
When your payment is confirmed, WPPres grants you a non-exclusive, non-transferable licence to install and use the Software, limited by the plan you purchased:
- Standard — activation on one (1) production website.
- Premium — activation on up to five hundred (500) production websites.
- Agency — activation on an unlimited number of production websites that you own or manage on behalf of clients.
All plans allow an unlimited number of point-of-sale registers on each licensed site. Staging, local and development copies of a licensed site do not count towards your activation limit.
3. What you may not do
You agree not to:
- resell, sublicense, rent or redistribute the Software as a standalone product;
- remove or obscure any copyright, licence key or attribution notice;
- attempt to defeat, bypass or disable the licence activation mechanism;
- use the Software to operate a service that is substantially the same as StorePOS in competition with us;
- use the Software for any unlawful purpose or in breach of any applicable regulation.
The PHP portions of the Software are licensed under the GNU General Public License v2 or later. Nothing in these terms restricts the rights granted to you under that licence in respect of that code. The restrictions above apply to our licence keys, updates, support services, branding and any non-GPL assets we supply.
4. Payment and the merchant of record
Our order process is conducted by our online reseller Paddle.com Market Ltd (“Paddle”). Paddle is the merchant of record for all our orders. Paddle handles the payment, the invoice, and the collection and remittance of any sales tax, VAT or GST that applies to your order.
This means that when you buy a StorePOS licence, your contract for the purchase is with Paddle, and Paddle’s own buyer terms apply to that transaction alongside these terms. WPPres remains responsible for the Software itself, for updates, and for support.
All prices are stated in US dollars unless shown otherwise at checkout. Paddle may present your local currency; the exact amount to be charged is always shown before you confirm your order.
5. Term, renewal and cancellation
Licences are sold for a term of twelve (12) months and renew automatically at the then-current price unless cancelled before the renewal date. You will be notified by email before a renewal is charged.
You may cancel automatic renewal at any time, either from the link contained in your Paddle receipt or by asking us through the contact page. Cancelling stops future charges; it does not end your current paid term, and it does not by itself generate a refund.
When a licence term ends without renewal, the Software continues to function. What stops is your access to updates, new versions and support.
6. Refunds
Our refund terms are set out in full in our Refund and Cancellation Policy, which forms part of these terms.
7. Updates and support
An active licence entitles you to all updates we release for the Software during your term, and to support through the channels described on our website for the plan you purchased. Support covers the Software itself. It does not cover general WordPress administration, server configuration, third-party plugins and themes, or custom development.
We aim to respond to support requests within one business day, but we do not guarantee a particular response or resolution time.
8. Your responsibilities
You are responsible for the website on which you install the Software, for maintaining current backups, for the security of your WordPress installation and hosting, and for the accuracy of the tax, pricing and product data the Software relies on. You are responsible for ensuring that your use of the Software complies with the fiscal, retail and consumer-protection rules that apply to your business in your jurisdiction.
9. Intellectual property
Except for the rights expressly granted in section 2, WPPres and its licensors retain all right, title and interest in the Software, its trademarks, its branding and its documentation. Data you process through the Software remains yours; we do not claim any ownership of it.
10. Disclaimer of warranties
The Software is provided “as is” and “as available”. To the fullest extent permitted by law, WPPres disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Software will be uninterrupted, error-free, or compatible with every combination of plugin, theme, hosting environment and hardware.
11. Limitation of liability
To the fullest extent permitted by law, WPPres shall not be liable for any indirect, incidental, special, consequential or punitive damages, nor for any loss of profits, revenue, sales, goodwill or data, arising out of or in connection with your use of the Software.
Our total aggregate liability arising out of or in connection with these terms shall not exceed the amount you actually paid to us for the licence in the twelve (12) months preceding the event giving rise to the claim.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded.
12. Termination
We may suspend or terminate your licence if you materially breach these terms and do not remedy the breach within fourteen (14) days of being notified. On termination the rights granted in section 2 end, and you must stop using licence keys, updates and support.
13. Changes to these terms
We may update these terms from time to time. The “last updated” date at the top of this page shows when they were last changed. Material changes will be communicated to licence holders by email. Continued use of the Software after a change takes effect constitutes acceptance of the revised terms.
14. Contact
Questions about these terms should be sent to WPPres through our contact page.
